PUBLIC HEARING AND INTENT TO ISSUE PERMIT
FOR A SOLID WASTE DISPOSAL FACILITY
The Tennessee Department of Environment and Conservation, Division of Solid Waste Management (DSWM), will conduct a public hearing to receive comments on its tentative decision to issue a solid waste disposal facility permit for a major modification to Environmental Waste Solutions, LLC for construction, operation, closure, and post-closure care of to the existing Class II landfill for the disposal of secondary Aluminum smelter wastes, shredded automotive tires, construction/demolition waste, waste derived from coal combustion, and/or certain special wastes approved in writing by the Department. In accordance with Tennessee Rule 1200-1-7-.02(5)(b)2.(v), only those conditions that are being modified are reopened when a draft permit is prepared. All other aspects of the existing permit remain in effect for the duration of the unmodified permit.
The hearing, which is being scheduled at the request of the applicant, Environmental Waste Solutions, LLC, will be held on Tuesday, July 26, 2011 in the Courtroom of Benton County Courthouse, 1 East Court Square, Camden, Tennessee. From 5:30 p.m. to 6:00 p.m. (CDT), citizens are invited to inspect and discuss the permit application, draft permit, fact sheet, plans, and other materials with the DSWM and with representatives of the applicant. There will be an opportunity for public comments to be recorded or written and submitted from 5:30 p.m. to 6:00 p.m. The formal hearing will begin at 6:00 p.m. The DSWM will explain its tentative decision to issue the permit, after which the applicant's representative will describe the proposed facility action/expansion. DSWM will then receive oral comments on the draft permit from the public.
The facility, identified as IDL 03-0212, is located in Benton County, at 200 Omar Circle, Camden, Tennessee (latitude 36°03'16" N/ longitude 88°05'16" W). The proposed modification reflects the changes associated with the enhancement of the liner/leachate collection system design. No hazardous wastes, as regulated by the Tennessee Hazardous Waste Management Act (Tennessee Code Annotated, Section 68-212-101, et. seq.) and the Rules adopted pursuant to the Act, shall be accepted for disposal at this facility. The official responsible for operation of the facility is Mr. Scott Sohr, President, Environmental Waste Solutions, LLC, 4521 Trousdale Drive, Nashville, Tennessee 37204; telephone: 615-333-0100.
Following an in-depth review of the application, DSWM has made a preliminary determination that this proposal meets the applicable requirements of Tennessee Rule Chapter 1200-1-7, Solid Waste Processing and Disposal. It is the present intent of DSWM, pending consideration of any contrary technical information received during the public comment period ending on August 15, 2011, that this permit be issued.
The public is also invited to submit comments in writing to: Mr. Mike Apple, Director, Division of Solid Waste Management, 5th Floor, L&C Tower, 401 Church Street, Nashville, TN 37243-1535; telephone: 615-532-0780. Comments must be received by 4:30 p.m. (CDT) on Monday, August 15, 2011, to assure consideration. If you wish to review the data for this proposal or obtain further information prior to the hearing, please contact the DSWM at the TDEC Jackson Environmental Field Office, 1625 Hollywood Drive, Jackson, Tennessee; telephone: 731-512-1300. A copy of the data on this proposal may also be viewed at the Benton County Library, 121 South Forrest Avenue, Camden, Tennessee 38320-2055; telephone: 731-584-4772. After considering all public comments, the DSWM Director will issue a final permit decision and a Response to Comments, which can be viewed at the Benton County Library or at the DSWM Environmental Field Office in Jackson, Tennessee.

We have also received e-mails and letters from many people in the Camden community concerning the ammonia odors currently coming from the landfill onto their property. The Department is charged with protection of public health and environment and our goal is to insure that the EWS Landfill in Camden (the landfill) is operated properly. We realize you are very frustrated with the continuing odor problems from the landfill. We are continuing to work with EWS to eliminate ammonia odors from the existing landfill.



Regarding the request from EWS to construct the next disposal cell for secondary aluminum waste, the Department has reviewed the request and tentatively approved that request. This information was included with the recent Public Notice in the Camden Chronicle. The Department will conduct a Public Hearing on July 26, 2011 beginning at 5:30 PM in Camden at the Benton County Courthouse. The purpose of the meeting is to receive oral comments about the construction of the next waste cell at the landfill from anyone who wishes to speak. The Department will receive written comments until close of business on August 14, 2011.



Many people have asked how the Public Notice, Public Hearing and Public Comment period works. The Department has placed copies of the tentatively approved permit modification in the Camden Library for people to review. Anyone who wishes may review the draft permit and then submit comments in writing to the Department or provide oral comments at the Public Hearing. The Public Hearing on July 26, 2011 will follow this schedule:



1. The meeting area will open at 5:30 PM. The Department will have staff members present to answer questions from folks attending.

2. At approximately 6:30 PM, the Public Hearing will begin. The Department will ask any person who wishes to make oral comments to complete a card with their name.

3. The Permittee will make a presentation to the attendees describing the construction of the waste cell.

4. The Department will provide all interested parties with the opportunity to make comments about the next waste cell. People will be called to speak randomly, from the cards completed when the meeting began at 6:30 PM. If there are a large number of people who wish to speak, then the speakers may be limited to a specific amount of time to make their comments. The hearing is scheduled to end at 9:00 PM, however, the Department generally stays as long as necessary to receive comments.

5. The oral comments will be transcribed and included along with written comments the Department receives for consideration and response.



After the public comment period ends, the Department is required to prepare a response to all comments received during the Public Comment period. As the Department prepares the “response to public comments document,” it considers the comments received and makes a decision about the permit modification request. The Department has three different decisions it can make based on the comments received:



1. The permit modification is granted by the Department and EWS receives permission to construct the next waste cell;

2. The permit modification is denied by the Department and EWS cannot construct the next waste cell unless it appeals the Department’s decision;

3. The Department determines it needs additional information before it can reach a final decision and reopens the Public Notice and Comment period.
